BOOKING FEE 
Your initial booking fee of £100 for a wedding cake or £20 for  celebration cake  reserves your event date and is non-refundable. The contract is not valid or binding untill the booking fee has been received. 

CANCELATIONS 
If for any reason you wish to cancel your order please email bakesbykerry@gmail.com
In the unfortunate event you have to cancel your order, please note that booking fee is non refundable. 
CELEBRATION ORDERS 
Any items bought specifically for your cake or any work already completed for your order will be deducted from cake cost if cancelled. 
WEDDING ORDERS 
Orders cancelled within 14 days of paying the booking fee will receive a full refund.
orders cancelled after 14 days of paying the booking fee will loose the fee.
orders cancelled within 12 months of wedding date are not entitled to any refund for any amounts paid.
Orders cancelled within 6 months of wedding date are liable for 50% of order total.
Orders cancelled within 8 weeks of the balance due date will be liable for the full amount owed.
POSTPONEMENTS 
In the event of a postponement, provided the new date is available there will be no transfer fee and the full order will be moved to a new date. Any price increases will be discussed, although you should not expect more than a 10% increase, if this is applicable.
Should the new date not be available please revert to cancellation policy.

ME CANCELLING 
If in the extremely unlikely event i have to cancel your order, i will give as much notice as possible, and refund monies paid.
In the extreme situation of me not being able to deliver your cake due to reasons out of my control, for instance hospitalised, ill health etc, I will if I am able help find a replacement cake designer and refund your money as per covered by my insurance. 

PAYMENTS 
Bakes by Kerry  must receive the balance by the due date indicated or contract is null and void, and booking fee  will not be refunded.
The date of your final payment is given upon payment & one reminder will be sent, failure to pay will mean the order is cancelled

Last minute orders will need full payment on date the order is accepted
DESIGN
I will strive to create your cake as per our discussion's, however if the design may need to be altered for it to work on the cake but kept as close as possible to what we discussed. 
all items are handcrafted so there can be slight variation in colour and detailing.
WEATHER/CLIMATE CONDITONS
it is the reasonability of the customer to ensure that the cake will be stored/ set up in a area that is climate controlled to ensure the wedding cake remains in tact and retains original condition.
extreme high temperatures and humidity due to weather conditions and the lack of cold environment at the location may adversely effect the condition of the cake. Bakes by Kerry will take every step possible to ensure a quality product upon delivery. Bakes by Kerry cannot be held responsible for unfavourable conditions at the cakes destination.

FLOWERS
If you are using real flowers for your cake design, please have your florist provide the exact number of correct flowers or foliage needed to complete final design & left with venue for me to use on arrival to set up for your wedding delivery.
I am not responsible for damages that occur if other parties attempt to place flowers into the cake after delivery. If flowers are provided by an outside source, Bakes by Kerry will use them to achieve the look we discussed or as close as possible to original design. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants. Bakes by Kerry will only use flowers from the non-toxic lists. These will have been laid on/ inserted into the cake with wrapped stems and Posey picks/straws. All flowers should be handled with care and removed before serving.

CHANGES: 
Any changes to design, flavour or style after a final sketch/quote has been sent, after this date any changes can have increase in charges to cover the changes if I can achieve them in the time frame given. 

DELIVERY/COLLECTION
Delivery and setup is depending on the location of the venue and will be stipulated in the final price.
We are not responsible for any damage to the cake after setup is complete. 
You are responsible for providing an appropriate and secure table and environment for the cake(s). Cakes are heavy and require a sturdy table. 
Your order maybe collected at a pre-arranged time, I will do my best to accommodate requested collection time. Please be sure to schedule your pick up/delivery time time as accurately as you can. if you feel like you are going to be late, please contact as soon as possible. 
Bakes by Kerry is not liable for damage due to client handling once the cake has been collected or delivered. If your cake is damaged after it is in your possession, Bakes by Kerry will assess the damages and may, if circumstances allow, offer to fix the cake for you. If Bakes by Kerry has to travel to you to repair the cake, mileage fees will be applied. In addition, further costs maybe be incurred depending on the severity of the damage to the cake. 
When delivering to your venue, at the time of set up and delivery a designated responsible party must be present to inspect and sign for final cake set up, this may be your wedding coordinator, planner or caterer.
Once set up has been complete Bakes by Kerry is no longer liable for your cake, however if any damage does occur please contact me and ill advise to the best of my knowledge on how to fix it.
On collection you will be asked if your happy with your product, by taking your cake from my premises, you confirm you are happy with its condition and final overall presentation. 
If you or your representative elects to pick up and set up the cake, you assume all liability and responsibility for the condition of the cake once it leaves our possession. 
You are advised that when transporting your cake it should be kept in the box provided on a flat clean surface. the flat surface of a car boot (with no items that could fall into it) or in the footwell of a passenger seat is the ideal place for the box to be placed. It should be out of direct sunlight. It should not be transported on a car seat.

SOCIAL MEDIA/PHOTOGRAPHY
Bakes by Kerry reserves the right to use photographs of cakes and products made by them for advertising purposes, marketing and promotion of the business. Any photos Bakes by Kerry takes will belong to Bakes by Kerry. This will include social media for example Facebook, Instagram and Website. The photos maybe used for future publications or advertising. Should you send any photos to Bakes by Kerry ie of the cake cutting, this will be seen as permission to share on our website and social media. These will not be submitted for social or websites unless we have your permission. If any professional photos are shared with us we will credit the photographer. Bakes by Kerry will not publish pictures until after the date of your celebration so that we do not spoil your big reveal. 

JUST INCASE 
Performance of this agreement is contingent upon our ability to complete the Agreement and is subject to labour disputes or strikes, accidents, Acts of God, and other causes beyond our control.
COLOURS 
Bakes by Kerry cannot guarantee certain colour matches or exact replicas, but will do our best to accommodate requests.

ALLERGIES 
Please be aware that whilst your chosen cake may not be made with nuts or gluten or a nut product, it will be prepared in aa kitchen that handles nuts & other allergens.
Whilst every effort is made to produce 'free from' cakes, customers should be aware that they are produced in the same area as non 'free from' cakes. 
As a result it can not be guaranteed there will be no traces of allergen ingredients. clients are responsible for notifying Bakes by Kerry of any dietary restrictions prior to placing an order. 
Bakes by Kerry  products are made in an environment where soy, egg, gluten, dairy, nuts, and other allergens are present. When specified by the client Bakes by Kerry will take all due care to keep allergy prone ingredients out of the area being used to make your product. 
Details of any allergens within your bake will be provided with your order. 

NON EDIBLE ITEMS 
Many cakes contain food safe non-edible items which may include( but are not limited to)dowels, florist wire, ribbons, straws, boards and flowers. You will be advised of the placement of such items, however it is your responsibility to ensure that your venue / caterer/guests are aware that these items should be removed prior to consumption.

 DISPUTES/REFUNDS 
Any refund given for disputes regarding cake design or production of a design is at the discretion of Bakes by Kerry. Full refunds will not be given for any cake that has been consumed regardless of dispute, as consumption of the cake is viewed as your acceptance that the cake/product is adequate for the purpose for which is has been supplied. 
If for some reason you deem the cake or product inedible and unfit for use, you will need to return the product to Bakes by Kerry's premises within 12 hours of collection in order that the product can be examined.
CAKE CARE
Should any cake be left over from your celebration please follow the advise below.
Please store your cake in the box supplied either with the cake on collection or the one left with the venue coordinator. Please keep in a cool room away from direct sunlight. 
please don't not place your cake into the fridge this causes the cake to dry out and the icing to sweat. Once the cake has been cut please wrap any cut edges in cling film to preserve the freshness. Please consume within 3 days for maximum freshness.
Should you have cake remining, you can slice into smaller pieces and wrap well in cling film and place into a freezer safe zip lock bag and freeze for up to 3 months. 
for defrosting, allow 1-2 hours to fully defrost before eating.

GDPR 
When you contact Bakes by Kerry about ordering a cake, we have to collect a small amount of data, usually your name and contact details (phone and email). Sometimes if delivery is required we may need your home address.
If you pay by online banking we do not hold your bank or card details or have access to them. Bakes by Kerry  will never share your personal details with any other company. Ar Bakes by Kerry, we only use the data you have given to us to administer your account while your enquiry and order is active. Once the order is complete we may contact you to ask for a review, should you not wish to be contacted please let us know. Your data will never be shared with 3rd party company.
You may request details of your personal information which we hold under the data protection act. you may request for this information to be deleted at any time.
